Chapter 13 (Consumer Bankruptcy)

If you make substantially more than the median income, if you are behind on your mortgage or car loans, if you are behind on your taxes or domestic support obligations, then chapter 13 is probably right for you.  We’ll figure out if you must be in a five year plan or if you are eligible for a three year plan.  We’ll figure out how much you are required to pay and will work hard to figure out the minimum you’ll have to pay to satisfy the requirements of the Bankruptcy Code, the Chapter 13 Trustee and the Court.  We’ll take advantage of the opportunities the law provides for you and we’ll inform you as to areas where the law is uncertain.  We keep up to the minute on the latest decisions from our local courts and from courts around the nation.  Chapter 13 is changing every day under BAPCPA, the changes to the Bankruptcy Code in 2005.  With Lakelaw, you’ll know where you stand and you won’t be surprised, ambushed or blindsided.  If there are areas of concern, you’ll be the first to know and we’ll be the first to tell you.  We’ll also use chapter 13 to pursue any claims you might have which might reduce your plan obligation.  We’ll object to claims as necessary and we’ll file claims against your creditors under the Truth in Lending Act, Real Estate Settlement Procedures Act, Fair Debt Collection Practices Act and any other consumer protection statute which can be properly utilized in your favor.  Any recovery we make will have the effect of reducing your obligations under the chapter 13 plan.  And if your circumstances change during the chapter 13 case, we’ll be there for you to seek modifications of the plan to suit your new economic conditions.
